Requirements for Family Visas

The USCIS has established certain criteria that must be met when attempting to bring a family member to the United States. Parents, fiancées, unmarried children under 21, adult children and adult siblings may all apply for family visas or green cards for entry into the country. A family member in the United States must sponsor that entry. Requirements for sponsors include the following:

  • Sponsors must be able to prove that they are legal relatives of the family visa applicant
  • Sponsors must be naturalized citizens or legal residents of the United States
  • Sponsors must be able to prove that they will financially support their family member

The process for sponsorship includes the approval of a Petition for Alien Relative (form I-130) for visa entry into the United States. As soon as it becomes available, the U.S. State Department will assign an immigrant visa number to the petition, which will make you eligible to apply for status as a lawful permanent resident.
